What catches people out in West Virginia

  • West Virginia has 5 brackets for a single filer, running from 2.11% on the first dollar up to 4.58% above $60,000.
  • Joint filers use the SAME bracket floors as single filers rather than doubled ones, so two people earning similar amounts reach each rate at half the combined income they would have as individuals. That is a marriage penalty written into the schedule, and it is the opposite of how the federal brackets work.
  • West Virginia grants no state standard deduction, so its rate applies from the first dollar of taxable income. That is why a low headline rate here is not as low as it looks next to a state with a large deduction.
  • Every rate here is 5% lower than most 2026 tables show. Senate Bill 392, signed 31 March 2026, delivered an across-the-board 5% individual income tax cut retroactive to 1 January 2026, codified at W. Va. Code 11-21-4j from 12 June 2026, and the figures used are the adjusted rates the West Virginia Tax Division publishes rather than a reduction computed from the old ones. Band boundaries did not change. West Virginia offers no standard deduction, so its rates apply from the first dollar of taxable income - which is why a low headline rate here is not as low as it looks beside a state with a large deduction. Married filing separately uses the same rates against halved boundaries, a status this estimate does not cover. States are not parties to the India-US tax treaty, and a state credit for "taxes paid to other jurisdictions" almost always means other US states rather than other countries.

So NRO interest, Indian rental income or a gain on Indian shares can be taxed by West Virginia with no credit for the Indian tax deducted at source — even though Form 1116 largely neutralises that same tax federally.
